CRAZY JOBS Customer Agreement

a) This Agreement governs your access to and use of:

• i) the Platform; and
• ii) all features, functions, information and services made available through the Platform (collectively, the "Services").

b) This Agreement is between you and CRAZY JOBS, a corporation existing under the laws of the Province of Newfoundland and Labrador, Canada.

c) By using the Platform, you acknowledge that:

• i) CRAZY JOBS operates an online marketplace that connects you with independent individuals and businesses who offer to perform tasks and services (the "Service Providers"); and
• ii) CRAZY JOBS is not a party to the contract between you and any Service Provider and is not responsible for the work performed or for the conduct of Service Providers.

a) By accessing or using the Platform, including by:

• i. creating an account;
• ii. posting a job or service request;
• iii. browsing or contacting Service Providers; or
• iv. clicking "I Agree" or similar acceptance buttons,

your heirs, assigns and successors ("you" or "your") represent and warrant that:

• You have read, understand and agree to be bound by this Agreement and any future amendments;
• You are at least 19 years of age and legally capable of entering into a binding contract in the jurisdiction where you reside;
• You have authority to bind any organization on whose behalf you use the Platform; and
• You will comply with all applicable laws when using the Platform.

If you do not agree to this Agreement, you may not access or use the Platform.

a) CRAZY JOBS reserves the right to modify this Agreement, the Services, or any policies referenced herein at any time.

• i. Updated Terms will be posted on the Platform and may be accompanied by notice (for example, by email, in-app notification, or banner).
• ii. Changes take effect on the date indicated in the updated Agreement.

b) Your continued access to or use of the Platform after such changes constitutes your acceptance of the revised Agreement. If you do not agree with the updated Agreement, you must immediately stop using the Platform and close your account.

a. You understand and agree that CRAZY JOBS:

• i. operates as an online marketplace platform only;
• ii. does not provide cleaning, handyman, delivery, tutoring, digital, caregiving, or any other services advertised on the Platform; and
• iii. does not supervise or control the work of Service Providers.

b. Service Providers are independent contractors, not employees, partners, agents, franchisees or representatives of CRAZY JOBS. CRAZY JOBS does not:

• i. set Service Providers' working hours;
• ii. control the manner or method of performing services;
• iii. supply tools, equipment, or materials; or
• iv. provide employment benefits, coverage or protections.

c. CRAZY JOBS is not responsible or liable for:

• i. the quality, safety, legality, or timeliness of services performed by Service Providers;
• ii. any acts, omissions, negligence, misconduct, misrepresentation or breach by a Service Provider;
• iii. any damage, loss, injury, or other harm arising from your dealings with a Service Provider.

d. Any service contract formed is solely between you and the Service Provider. CRAZY JOBS is not a party to that contract and does not guarantee its performance.

a. You understand and agree that:

• i. Job Budgets and Prices:
  • You may post a job with a proposed budget.
  • Service Providers may accept that budget or propose a different price.
  • The final service price is agreed directly between you and the Service Provider, usually facilitated via the Platform.
• ii. CRAZY JOBS Fees:
  • CRAZY JOBS charges service and/or platform fees for facilitating the marketplace.
  • These fees may be charged to you, included in your total price, or charged to the Service Provider (or a combination).
  • Any applicable fees will be disclosed on the Platform at or before checkout.
• iii. Taxes:
  • You are responsible for all applicable taxes relating to services you purchase.
  • CRAZY JOBS may estimate, collect and remit taxes as required by law.

b. Payments are processed through third-party payment processors (e.g., Stripe). By making a payment via the Platform, you:

• i. authorize CRAZY JOBS and the payment processor to charge your selected payment method;
• ii. agree to comply with the payment processor's terms and conditions;
• iii. acknowledge that CRAZY JOBS is not responsible for errors or breaches by the third-party processor.

a. To the fullest extent permitted by law:

i. Cap on Liability: CRAZY JOBS's total aggregate liability to you for any and all claims arising out of or in connection with this Agreement or your use of the Services shall not exceed the greater of:

• the total fees paid by you to CRAZY JOBS in the six (6) months preceding the event giving rise to the claim; or
• $250 CAD.

ii. Exclusion of Certain Damages: CRAZY JOBS shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including loss of profits, loss of business, loss of goodwill, data loss, or personal injury or property damage arising out of or in connection with:

• your use of the Platform;
• your dealings with Service Providers;
• any services performed or not performed by Service Providers;
• any acts or omissions of third parties.

a. If you have a concern or complaint regarding the Services, you may contact CRAZY JOBS using the contact information below. CRAZY JOBS will make reasonable efforts to respond and address your concerns.

b. Nothing in this Agreement is intended to limit any non-excludable rights or remedies you may have under applicable Canadian or provincial consumer protection laws.
